The ILUA applies to a total of 5 square kilometres located approximately 3 kilometres west of Yarrabah Aboriginal Community. Yarrabah Aboriginal Community is a small community with just over 3000 people of which over 96% identify as being Aboriginal or Torres Strait Islander (Australian Bureau of Statistics, 2007). Yarrabah Aboriginal Community is located south east of Cairns in far north Queensland. | ||

The Yarrabah Protected Areas Indigneous Land Use Agreement (ILUA) is an area agreement made between the State of Queensland (Applicant) and Les Murgha on his own behalf and on behalf of the Gunggandji People, the Wet Tropics Management Authority and the Gunggandji PBC Aboriginal Corporation. The ILUA commences on the later of registration on the Registar of Indigenous Land Use Agreements and a determination in any part of the agreement area. The ILUA will terminate by written agreement and if there is a determination by the Federal Court of Australia that native title does not exist in part of the agreement area. In such cases, the agreement will only expire in relation to that part of the agreement area. The purpose of the ILUA is to allow for co-management of the protected area under the agreement. | ||

Terms of the Agreement The ILUA applies to an area of approximately 5 square kilometres located approximately 3 kilometres west of the locality of Yarrabah, over which co-management arrangements have been negotiated with the native title applicants. Background Native title history Mr Les Murgha and Mr Stewart Harris, on behalf of the Combined Gunggandji People are currently seeking a determination of native title pursuant to the Native Title Act 1993 (Cth). The claim area lies to the south of Cairns, borders Mission Bay and includes the Yarrabah township. There are numerous respondents including the State of Queensland, Yarrabah Aboriginal Shire Council, Ergon Energy Corporation Limited, Telstra Corporation Limited, numerous fisherman and others. The application was accepted for registration in 2008 having passed the registration test. |
