Details of the Agreement From the date of registration the parties to the agreement consent to agreed future acts. The future acts include the grant or renewal or extension, within the ILUA area, of any Exploration Permit for minerals under the Mineral Resources Act 1989 (Qld) to Renison Consolidated Mines NL. The parties also agreed that Subdivision P of Division 3 of Part 2 of the Native Title Act 1993 (Cth) was not to apply to the agreed future acts. Background The parties The Ewamian Aboriginal Corporation was incorporated by the Ewamian People in 1994 pursuant to the Aboriginal Councils and Associations Act 1976 (Cth). The Association is established in order: A) To obtain, hold and manage land for the Ewamian people. B) In particular act as trustees for the area known as Georgetown and Forsayth Reserve. C) To jointly manage Bulleringa National Park with the Department of Environment and Heritage. D) To undertake employment, enterprise, training and other activities necessary to carry out these objectives. E) To seek and apply for grant funding for these activities. F) Preservation of traditional culture." (Ewamian Aboriginal Corporation, Articles of Association, 2004). Native title history The Ewamian People have registered two applications for a determination of native title with respect to land and waters in northern Queensland. The first of these, the Ewamian People #2 claimant application, was filed with the Federal Court of Australia on 18 March 1999 as proceeding QUD 6009 of 1999. It covers land in the Georgetown area in northern Queensland. The second, the Ewamian People #3 claimant application, was filed on 30 April 2001 as proceeding QUD 6018 of 2001. While both of these claims remain active, neither is currently in mediation. |
