The Churdy Pool Siding Special Lease Indigneous Land Use Agreement (ILUA) is an area agreement between Robe River Mining Co Pty Ltd on its own behalf as a venturer and as manager for and on behalf of the Robe River Iron Associates Joint Venture (applicant) and Mark Lockyer, Neil Finlay, Jack Alexander, Jean Lockyer and Gloria Lockyer on behalf of Kuruma Marthudunera People. The purpose of the agreement is to provide consent to agreed future acts required for the grant of a lease to the Robe River Iron Associates for the purpose of constructing, operating and maintaining a railway. The ILUA commenced upon the 18th of March 2011.

Details of the Agreement The purpose of the ILUA is to provide consent agreend future acts required for the grant of a lease to the Robe River Iron Associate under section 79 of the Land Administration Act 1997 (WA) over all or any part of the agreement area. The lease is granted in order for the Robe River Iron Associates to undertake the construction, operation and maintainence of a railway. The agreement area is around 15 hectares and is located 14 kilometres east of Pannawonica in Western Ausralia. Background Native Title History The Kuruma and Marthudunera (combined) people filed an application for a determination of native title in March 1998 (Federal Court No WAD6090/98). That application was registered on the Native Title Register and is currently in mediation. The Kuruma Marthudunera claim covers some 15,717.407 square kilometres of land in the east Pilbara region and includes the mining town of Newman. The Kuruma and Marthudunera claim group has approximately 500 members.
