Summary Information:
The Australia Pacific LNG Pty Limited Wulli Wulli Djaku-nde and Jangerie Jangerie Indigenous Land Use Agreement is an area agreement between:
- Australia Pacific LNG Pty Limited and Australia Pacific LNG Gladstone Pipeline Pty Limited (individually and collectively, APLNG) (applicant); and
- Desmond Dodd, Robert Bond, Robert Clancy, Drew Millar, Neil Saltner, Marjorie Reid, Elizabeth Law, Elizabeth Blucher, Annette Fuller, Celeste Williams, Ivan Saltner, Jeffrey Williams, Brian Clancy, Jill Wilson, Elliot Anderson, James Saltner, Victor West and Alice West on his/her own behalf and on behalf of the Wulli Wulli/DJJ Native Title Claim Group.

The agreement commenced on 7 September 2011 with the purpose of providing consent to agreed future acts and the ILUA project.

Details of the agreement

Commencement and Termination

The ILUA commenced on 7 September 2011 and will operate for the duration of the agreed acts and the undertaking of the ILUA project, subject to the termination clause.

Future Acts

With regards to future acts the parties to the ILUA consent to:
- the agreed acts. The agreed acts include the granting of certain rights or interest necessary or desirable for, or incidental to, the ILUA project. The agreed acts also include any act relating to the use of the ILUA area for road purposes. For a more complete list see the the Notice of an application to register an ILUA; and
- the undertaking of the ILUA Project (which is part of the Pipeline Project which is located within the ILUA area). The pipeline project is defined as the construction and operation of a gas pipeline system (and other pipelines and facilities), to link the APLNG gas fields to the LNG plant on Curtis Island. Background to the ILUA

The project

The Australia Pacific LNG Project is a coal seam gas (CSG) to liquefied natural gas (LNG) project
The Pipeline Project comprises the construction and operation of a high pressure underground gas transmission pipeline system from Australia Pacific LNG's gas fields in south central Queensland to the LNG facility on Curtis Island near Gladstone, Queensland. The pipeline will facilitate the transmission of coal seam gas to the Curtis Island plant to be liquefied and exported. The area of the pipeline will occupy a 40 to 50 metre corridor of approximately 2,350 hectares (Australia Pacific LNG, 2010).

Overall the entire Australia Pacific LNG Project consists of three key parts:
1. Further development of Australia Pacific LNG's gas fields in the Surat and Bowen Basins in south-west and central Queensland;
2. Construction of a 520km gas transmission pipeline from the gas fields to an LNG facility on Curtis Island off the coast of Gladstone; and
3. An LNG facility on Curtis Island off the coast of Gladstone, with the first two gas production trains processing up to 9 million tonnes per annum.

The parties

Australia Pacific LNG is a joint venture between three industry companies in the fields of coal seam gas and liquefied natural gas production - Origin (42.5%), ConocoPhillips (42.5%) and Sinopec (15%). Origin is also responsible for the construction of the pipeline (Australia Pacific LNG Project Partners).

The Wulli Wulli People lodged an application for the recognition of native title rights and interests in 2000 over 5465 square kilometres of land surrounding Theodore in central Queensland(Federal Court file no: QUD6006/00; Tribunal file no: QC00/7). The claim has been registered (National Native Title Tribunal, Claimant application summary - Wulli Wulli People).

The Djaku-nde and the Jangerie Jangerie had their native title application QUD6009 of 2000 dismissed (West on behalf of the Djaku-nde and Jangerie Jangerie Peoples v State of Queensland [2011] FCA 840) however under s24CD(4) of the Native Title Act 1993 (Cth), any persons who claim to hold native title in relation to land or waters in the may be party to the agreement.
