The purpose of this ILUA is to enable a range of acts (Agreed Acts) which will allow the grant of a Trustee Lease to the Islanders Board of Industry and Service (IBIS). IBIS propose to build a Store on the ILUA land. Parties further consent to the IBIS undertaking acts necessary to operate the Business in accordance with the Trustee Lease throughout the term of the Trustee Lease. Native Title Provisions Parties agree that the Right to Negotiate will not apply to Agreed Acts to which the Native Title Party has consented. Native Title in the ILUA Area The Saibai Mura Buway (Torres Strait Islanders) Corporation hold land and inland waters of Saibai Island, Mawalmay Thoera Island, Thawpay Kawamag Island and Kuykuthal Kawamag Island on trust for the native title holders. The determination of native title in the area was made on 12 February 1999. |
