The IBIS/Mer Gedkem le Corporation/Aboriginal and Islander Affairs Corporation Indigenous Land Use Agreement was agreed between:

- Island Industries Board trading as Islander Board of Industry and Service (IBIS);

- Mer Gedkem Le (Torres Strait Islanders) Corporation RNTBC; and

- Aboriginal and Islander Affairs Corporation (Corporation).

The purpose of this ILUA is to enable the Islander Board of Industry and Services to obtain a trustee lease in order to operate a business.

Details of the Agreement

The parties to this ILUA consent to the following acts:
a) all acts necessary to obtain approval to the grant of a Trustee Lease by the Corporation to IBIS;
b) the consent of the Minister to the grant of the Trustee Lease if required ;
c) all acts necessary to operate the Business in accordance with the Trustee Lease throughout the term of the Trustee Lease;
d) the granting of the Trustee Lease and all acts necessary pursuant to the Trustee Lease including upgrade and extension of existing improvements on the Trust Land by the Trustee Lessee in accordance with the Trustee Lease;
e) All acts necessary to give effect to those acts.

The right to negotiate will not apply to the above acts.

Native Title in the ILUA Area
The Meriam people's ownership of Mer, Waier and Dauar Islands was recognised in two native title determinations: the Mabo decision and the Meriam People determination.
