The agreement area covers 38,719 square kilometres, is located in the vicinity of Mount Isa and extends north to Gregory Downs, east to Cloncurry and south of Dajarra. The agreement falls within the Local Government Authorities of Burke, Boulia, Carpentaria, Cloncurry, McKinlay Shire Councils and Mount Isa City Council. The agreement area is defined in Schedule 14 of the agreement as all that area of land and waters bounded by the external boundary to the Kalkadoon #4 Claim [QUD 579 of 2005] Area, including all land or waters within those boundaries excluded from that Claim Area by the Kalkadoon #4 Claim or the operation of the Native Title Act.
Legal Status: Registered with the National Native Title Tribunal on the Register of Indigenous Land Use Agreements on 19 October 2012. This is an authorised Area Agreement under the Native Title Act 1993 (Cth).

Kalkadoon Constitution Indigenous Land Use Agreement (ILUA) is an agreement between:
- the Kalkadoon People (applicant);
- Kalkadoon Native Title Aboriginal Corporation;
- Kalkadoon Community Pty Ltd;
- Kalkadoon Enterprises Pty Ltd;
- Kalkadoon Cultural Heritage Services Pty Ltd; and
- Kalkadoon Administrative Services Pty Ltd.

The parties intend the agreement 'to be a constitutional document for the Kalkadoon People and the Kalkadoon Organisations, for the management and conduct of the collective affairs of the Kalkadoon People in and in relation to the ILUA area'.

Details of the Agreement

According to Kalkadoon Community Pty Ltd, the Constitutional ILUA establishes the following principles of governance:
'1. All Kalkadoon organisations are accountable to the Kalkadoon people.
2. All Kalkadoon organisations commit to a statement of values and all office holders are bound by a Code of Conduct.
3. An independent probity officer has the power to attend meetings, access books and records of all Kalkadoon corporations and to investigate complaints.
4. The Board of Kalkadoon's organisations can have no more than one board member from any one Kalkadoon family to ensure participation in each corporation is spread evenly across the Kalkadoon community.
5. All Kalkadoon organisations acknowledge the importance of Kalkadoon elders in protecting traditional knowledge, custom and law.' (Nicole Courtman, Indigenous Corporate Partners).

Native Title Provisions

The Extract notes that there are no statements within the Agreement of the kind which are mentioned in 24EB(1) or 24EBA(1) or (4) of the Native Title Act 1993 (Cth), and so the consequences set out under these sections are not triggered by this agreement.

This means that the ILUA does not:
- provide consent for the doing of any acts by non-native title parties;
- effect the right of the native title parties to negotiate with non-native title parties proposing to undertake a future act; nor
- validate any previous future acts.

Native Title in the ILUA Area

In Kalkadoon People #4, The Federal Court of Australia made a determination recognising the native title rights and interests of the Kalkadoon people over nearly 40,000 square kilometres in the mineral rich Greater Mount Isa Region of North West Queensland. The determination covered 38,719 square kilometres of land and waters in the Mt Isa region, including areas of reserves, unallocated State land, pastoral leases and other leases.

The consent determination and associated Indigenous Land Use Agreement recognises the Kalkadoon People's exclusive native title rights over 4078 square kilometres of land and non-exclusive native title rights over about 33,432 square kilometres of land and waters.
