The ILUA area covers all land and waters that are within the Wongkumara People native title determination application. The application excludes any area subject to the following native title determination applications: - QUD6033/02 - Mithaka People QC02/35 as accepted for registration on 24 June 2009; - QUD80/09 - Kullilli People QC09/1 as accepted for registration on 19 October 2011; and - QUD435/06 Boonthamurra People QC06/15 as accepted for registration on 14 September 2011. | ||

The Santos-Wongkumara People Indigenous Land Use Agreement (ILUA) is an area agreement between: - Santos Ltd (applicant); and - Clancy McKellar, Iona Dawn Smith, Ernest (Hope) Ebsworth, Rosemary (Rose) Anne Wilson, Margaret Anne Collins, Sharleen Louise Knight, Archie Ebsworth and Noelene Margaret Edwards in their capacity as the Wongkumara Claimants on their own behalf and on behalf of the Wongkumara Native Title Claim Group (the native title claim group for claimant application QUD52/08). The purpose of this ILUA is provide Santos Ltd with petroleum tenements, approvals and the authority to undertake petroleum activities in the ILUA area. | ||

Details of the Agreement Commencement The ILUA commences on the commencement date; that is, the day on which the ILUA is executed by all of the parties. It terminates in the event of a contrary determination, if the ILUA is not registered by 5 April 2015, or by mutual agreement of the parties. Agreement The Wongkumara claimants consent to: - the grant of petroleum tenements; - the grant of approvals; and - the doing of petroleum activities. The parties agree that the right to negotiate under the Native Title Act 1993 (Cth) does not apply to any future act subject to a consent(those consents given by the Wongkumara Claimants utilized by the petroleum entities to obtain the grant of a petroleum tenement under this ILUA) or the no challenge option. Native Title in the ILUA Area The Wongkumara People People lodged a native title claim on 11 March 2008. Their claim was accepted for registration on 12 April 2008. The area subject to the native title claim covers approximately 50,230 square kilometres of land and is located in the vicinity of Eromanga in south-west Queensland and Tibooburra in north-west New South Wales. |
