Details of the Agreement

Commencement and Duration

The ILUA commences on the day it is executed by the two parties to the ILUA. This date is not specified in the ILUA extract. It operates for the duration of the granted licences unless it is terminated by agreement in writing.

Agreement

The parties to the ILUA agree that Subdivision P, Division 3, Part 2 of the Native Title Act 1993 (Cth), concerning the right to negotiate, does not apply to the licence granted.

The parties also agree:
- to the grant by the State of Victoria of the licences to Ironbark Mining Pty Ltd and to any consent required by or on behalf of Ironbark Mining Pty Ltd pursuant to the licences in respect of the licence areas; and
- to the use of the licences and of any consent required pursuant to the licences, by Ironbark Mining Pty Ltd in respect of the licence areas; and
- that any such exploration done in respect of the licence areas is valid.

Native Title in the ILUA Area

The Dja Dja Wurrung Peoples filed a native title claim with the Federal Court of Australia as proceeding VID6001/00 on 19 July 2000. On 28 March 2013, the Victorian Government and the Dja Dja Warrung people reached a native title settlement, recognising the Dja Dja Wurrung people as the traditional owner group for approximately 266,532 hectares of Crown land in central Victoria. The ILUA area is a part of this land.
