The Agreement Area covers approximately 854 square kilometres over the Gunai/Kurnai consent determination area (Tribunal file no.: VC97/4, Federal Court no.: VID6007/1998). It covers petroleum exploration permits 170, 172 and 173 and extends about 37 km northwest, 75 km northeast and 76 km southwest of Sale, in the state of Victoria. | ||

The Gunaikurnai and Icon Energy Indigenous Land Use Agreement (ILUA) is a Body Corporate Agreement between: - Gunaikurnai Land and Waters Aboriginal Corporation RNTBC (applicant); and - Icon Energy Ltd. The purpose of this body corporate agreement is to authorise the grant of permits to Icon Energy which allow for mining exploration and production activities, and to provide consent for any later act consisting of a right to mine within the ILUA area. | ||

Details of the agreement
This consent relates to the doing of certain future acts. The Extract provides that these activities acts are:
The Extract stipulates that the consent of the parties refers to actions related to the carrying out of exploration and production activities under the permits or under any later act.
The parties agree that the right to negotiate provisions of the Native Title Act 1993 (Cth) do not apply, as the alternative consultation provisions are to be followed instead.
This was the first claim to be settled under Victoria's new native title settlement framework, which is set out in the Traditional Owner Settlement Act 2010 (Vic).
