Details of the Agreement The ILUA was registered with the National Native Title Tribunal (NNTT) on 10 July 2014. The Extract does not specify specific start or end dates for the Agreement. However, the Extract does note that Clauses 8 - 11, 24, 26 - 28 commence on the Registration Date, being 10 July 2014. These clauses continue indefinitely. The remaining clauses of the Agreement commence on the Date of Execution and continue indefinitely. Native Title Provisions The parties to this Agreement provide consent for any future acts invalidly performed by the State to be validated. Furthermore, the parties consent to the State doing acts and activities (not outlined in Extract) within the Agreement Area after Registration of the Agreement. Where the State intends to perform acts after Registration, the State must comply with the Notification Protocol (not outlined in Extract.) In addition, the parties agree that Subdivision P of Part 2 Division 3 of the Native Title Act, concerning the right to negotiate, does not apply to the acts or activities consented to. Native Title in the ILUA Area The Agreement Area includes the Adnyamathanha No.1 Native Title Claim Stages 1 - 3, and the Adnyamathanha No.1 Native Title Claim - Angepena Pastoral Station. |
