The area subject to this agreement covers about 369 sq km, located northwest of Charters Towers consisting of the Great Basalt Wall and Dalrymple National Parks, in the State of Queensland. The Agreement falls within the Charters Towers Regional Council boundaries. The ILUA Area includes all land and waters described as Lot 11 on Plan NPW348 (Great Basalt Wall National Park) and Lot 125 on Plan NPW636 (Dalrymple National Park). | ||

The purpose of this body corporate ILUA is to provide for the management and ongoing protection of the Dalrymple and Great Basalt Wall National Parks. | ||

Details of the Agreement The ILUA was registered with the National Native Title Tribunal (NNTT) on 5 August 2014. The Extract does not specify specific start or end dates for the Agreement. The Extract fails to outline with any specificity the terms of the Agreement. Native Title Provisions The Extract notes that there are no statements within the Agreement of the kind which are mentioned in 24EB(1) or 24EBA(1) or (4) of the Native Title Act 1993 (Cth), and so the consequences set out under these sections are not triggered by this agreement. This means that the ILUA does not: - provide consent for the doing of any acts by non-native title parties; - effect the right of the native title parties to negotiate with non-native title parties proposing to undertake a future act; nor - validate any previous future acts. Background Information Kevin Murphy, Director of Aboriginal and Torres Strait Islander Land Services, Department of Natural Resources and Mines, stated that "the ILUA regulates the Gudjala People's rights and interests within the national parks and addresses a range of issues including the permanent preservation of the areas' natural condition and the protection of cultural resources and values." |
