The Mining Act 1978 (WA) repealed the 1904 Act. It was passed after a protracted period of consultation and inquiry which determined that changes to the mining industry required that the 1904 Act be replaced. Four bills were presented to Parliament before this was to take place. Unlike the 1904 Act, the 1978 Act in its original form expressed Parliament's intention that explorers and miners would require the consent of private land owners prior to accessing their land. |
