Commencement This ILUA was registered with the Register of Indigenous Land Use Agreements on 13 February 2015. The Extract specifies the start date as 21 July 2014. No end date is specified for the Agreement. Native Title Provisions Subdivision P of Division 3 of Part 2 of the Native Title Act 1993 (Cth)is not intended to apply to any Future Acts for which the Native Title Parties have given consent under the Agreement. For the purposes of section 24EB(1)(b) of that Act, the parties consent to Surrender and thereby extinguish Native Title Rights and Interests in the ILUA Area. Native Title in the ILUA Area In the decision Barry Fisher & Ors on behalf of the Ewamian People #3 v State of Queensland & Ors, the Federal Court found Native Title in favour of the Ewamian People #3 (QUD6018/2001). The decision was made on 26 November 2013. |
