The Masig (Yorke Island) Defence Facilities ILUA was agreed between the Commonwealth of Australia acting through the Department of Defence, Masigalgal (Torres Strait Islanders) Corporation RNTBC and Torres Strait Island Regional Council on 16 October 2015. The purpose of the ILUA is to provide consent for a range of acts, whether or not they are 'future acts' regarding the setting up of a body corporate agreement. The agreement area is within the external boundary of the claim area for the Masig People.


Detailed Information:
Details of the Agreement: The ILUA is located in Torres Strait Island Regional Council. The agreement area covers about 730 sq metres on Lease Z in Lot 10 on TS179 Masig (Yorke Island).

Commencement: The ILUA commenced on 16 October 2015.

Native Title Provisions: The ILUA does have statements that reference subsection 24EB(1) or 24EBA(1) or (4) of the Native Title Act 1993(Cth).

Background to the Agreement: The ILUA allows a body corporate agreement to be set up between the parties.

Native Title in the ILUA Area: The ILUA is in the native title claim area which includes the land and waters the subject of the Federal Court proceeding Masig People v State of Queensland / Damuth People v State of Queensland [2000] FCA 1067.
