Summary Information:

This ILUA was agreed under the provisions of the Native Title Act 1993 (Cth) between Jubilee Downs Pastoral Co Pty Ltd and the Bunuba Dawangarri Registered Native Title Body Corporate ('RNTBC').

The purpose of the ILUA is to provide consent for a range of agreed acts regarding the Jubilee Downs pastoral lease.

The ILUA covers 111.2 sq km immediately west and north of Fitzroy Crossing Townsite in Western Australia.

The Native Title Representative Body for this area is the Kimberley Land Council Aboriginal Corporation.

Details of the Agreement:

The ILUA covers 111.2 sq km, immediately west and north of Fitzroy Crossing Townsite in Western Australia. The area covers part of the Jubilee Downs pastoral lease N050571.

Commencement and Termination: The ILUA commenced on 25 July 2017. The agreement ends when either pastoral lease N050571 ends, or the parties mutually agree in writing to end it.

Native Title Provisions:

The ILUA includes no statements mentioned in subsection 24EB(1) or 24EBA(1) or (4) of the Native Title Act 1993, and so the consequences set out under these sections are not triggered. This means that the ILUA does not: provide consent for the doing of any acts by non-native title parties; effect the right of the native title to negotiate with non-native title parties proposing to undertake a future act; nor validate any previous future acts.

Native Title in the ILUA Area:

The ILUA is within the area of native title recognised in the native title determinations WAD6133/1998 Bunuba (WCD2012/006) and WAD94/2012 Bunuba People #2 Part A (WCD2015/009). See attachment A of the agreement below for further details.
