Summary Information:

The Juru People Indigenous Land Use Agreement (ILUA) was made under the provisipns of the Native Title act 1993 (Cth) between the State of Queensland and the Kyburra Munda Yalga Aboriginal Corporation RNTBC.

The purpose of the ILUA is to provide consent for a range of acts, whether or not they are 'future acts,' regarding access.

The Native Title Registered Body is North Queensland Land Council Native Title Representative Body Aboriginal Corporation.

Detailed Information:

Details of the Agreement:

The agreement area is comprised of four parcels of land with a total size of approximately 0.16 sq km located west and southwest of Bowen. For a detailed description of the ILUA are see Schedule 1 of the ILUA below under documents.

Future act provisions:

The parties consent to the validation of any acts done by the State in the ILUA area prior to registration, to the extent they were done invalidly for the purposes of native title and can be validated in this Agreement.

The parties also consent to the surrender of the ILUA area. This means the surrender:

  • of the Juru Land Exchange Lots (see Part A1 of Schedule 2 under documents below); and
  • of the State Land Exchange Lots (see Part B of Schedule 2).

Extinguishment:

The parties agree that the surrender takes effect upon registration and that the surrender is intended to permanently extinguish all native title rights and interests in the surrender areas from the date the surrender takes effect.

Native Title in the Area

The ILUA area is within the area of the native title determination Lamington on behalf of the Juru People (Part B) v State of Queensland [2015] FCA 609 (FCA file no.: QUD554/2010; NNTT file no.: QCD2015/006).
