Summary Information:

The Dieri Geotechnics Indigenous Land Use Agreement ('ILUA') was agreed, under the provisions of the Native Title Act 1993 (Cth), between Geokinetics (Australasia) Pty Ltd and the Dieri Aboriginal Corporation Registered Native Title Body Corporate ('RNTBC').

The agreement area covers about 50,600 sq km of land northeast of Marree and about 55 km west of Innamincka.

The purpose of the agreement is for the Dieri people to provide their consent to speculative exploration activites within the agreement area.

The Native Title Representative Body for this area is South Australian Native Title Services Ltd.

Detailed Information:

Agreement area:

The agreement area covers about 50,600 sq km of land northeast of Marree and about 55 km west of Innamincka.

The Extract from the Register of Indigenous Land Use Agreements identifies the area subject to this ILUA, per Part F of the application for registration of the agreement, as the determined area of the Dieri Aboriginal Corporation RNTBC. See maps of the area attached to the extract below.

Commencement:

The agreement commences on 30 June 2016. It has effect as an ILUA from its registration date, 4 April 2017.

Termination:

The agreement continues until it is removed from the Register of Indigenous Land Use Agreements. In the event of a breach, the agreement will not end, but the parties may find a remedy for the breach under other lawful means.

Native Title Provisions:

Right to negotiate

The parties agree that the right to negotiate provisions of the Native Title Act 1993 (Cth) do not apply to the acts agreed to under this ILUA.

Extinguishment

The Dieri people's native title rights and interests are not extinguished by any acts done by the non-native title party under this agreement.

Future act provisions

The Dieri people consent to the Minister granting a Speculative Survey Licence, from time to time, under the Petroleum and Geothermal Energy Act 2000 (SA) to Geokinetics (Australasia) Pty Ltd. The Dieri also consent to the Geokinetics company acting within its rights and obligations under each licence granted.

Native Title in the Agreement Area:

The agreement is within the Dieri native title determination area in Gepp-Kennedy on behalf of the Dieri People v State of South Australia [2017] FCA 1156.
