Pardoo Beef Corporation Irrigated Agriculture Project Indigenous Land Use Agreement (ILUA)

Registered with the National Native Title Tribunal ('NNTT') on the Register of Indigenous Land Use Agreements on 20 November 2018. This is an authorised body corporate agreement under the Native Title Act 1993 (Cth).

The Pardoo Beef Corporation Irrigated Agriculture Project Indigenous Land Use Agreement ('ILUA') was agreed, under the provisions of the Native Title Act 1993 (Cth), between the following parties:

• Pardoo Beef Corporation Pty Ltd;
• the State of Western Australia acting through the Minister for Lands; and
• Wanparta Aboriginal Corporation Registered Native Title Body Corporate ('RNTBC').

The ILUA area covers about 116 sq km and is located on both sides of the Great Northern Highway about 15km north east of the Pardoo Roadhouse.

The purpose of the ILUA is the extinguishment of native title rights and interests within the agreement area, in the areas of the agricultural land containing freehold estates in fee simple and easements granted in relation to the freehold estates, by the Minister for Lands per the Land Administration Act 1997 (WA).

The Native Title Representative Body for this area is Yamatji Marlpa Aboriginal Corporation.

Agreement area:

The agreement area covers about 116 sq km and is located on both sides of the Great Northern Highway about 15km north east of the Pardoo Roadhouse.

Commencement and Termination:

The agreement commences on the date that all parties have signed. The ILUA came into effect from the date of registration on 20 November 2018.

Native Title Provisions:

Right to negotiate:

The parties agree that the right to negotiate provisions of the Native Title Act 1993 (Cth) do not apply to any of the agricultural land transactions agreed to by this ILUA.

Extinguishment:

The parties agree to the surrender and extinguishment of native title rights and interests in favour of the state, in respect of the sale, transfer or conveyance of agricultural land for an estate in fee simple.

The parties also agree to the surrender and extinguishment of all native title rights and interests in respect of the area of Easement 2.

Native Title in the Agreement Area:

This agreement is located within the native title determination area of the Federal Court of Australia (FCA) proceeding Brown (on behalf of the Ngarla People) v State of Western Australia [2007] FCA 1025. (FCA file no.: WAD6185/1998, WAD6003/2000, WAD77/2005, NNTT file no.: WCD2007/003).
