The Mamu People are registered native title claimants in Queensland (Federal Court File No. QUD6014/01). The agreement acknowledges and protects the cultural heritage values of the Mamu native title claimants. The Johnstone Shire Council and Mamu people agree to negotiate in good faith their respective interests within that native title claim and the Johnstone Shire Council agrees to be guided by the State Governments acceptance, for the purposes of mediation, of the Mamu as native title holders of the land and waters included in their claim for native title. The Mamu Aboriginal Corporation will be included in any Trust, Body or Corporate entity that is established for the effective ownership of the Canopy Walk and associated freehold land and the parties agree to explore options to ensure the flow on of sustainable economic benefits to the Mamu people. The agreement acknowledges that both the Queensland Parks and Wildlife Service and the Johnstone Shire Council have significant responsibilities for and interests in the management of the National Park and the surrounding shire. All parties are committed to work together in good faith to develop a participatory management regime for the ecologically, economically, socially and culturally sustainable management of the National Park and surrounding tenures and to develop harmonious relationships amongst all interests in the area that recognise the unique Mamu relationship to their traditional country. The agreement commits the parties to negotiate an Indigenous Land Use Agreement, or equivalent, to protect the native title rights and cultural heritage interests of the Mamu people in the National Park. The parties agree that areas of high conservation and cultural value shall be identified by a regional assessment process according to agreed national and international criteria. The agreement provides for an independent review acceptable to all parties in the case of a dispute in relation to the assessment of these values. |
