The Dauan Island Department of Home Affairs Indigenous Land Use Agreement (ILUA) was agreed, under the provisions of the Native Title Act 1993 (Cth), between the Commonwealth of Australia as represented by the Department of Home Affairs, Dauanalgaw (Torres Strait Islander) Corporation RNTBC (Registered Native Title Body Corporate) and Torres Strait Island Regional Council. The purpose of the ILUA is to allow the granting of a lease over Lot 77 on Dauan Island that provides access to communications facilities. The Native Title Representative Body for this area is the Torres Strait Regional Authority. | ||

Details of the Agreement Commencement and Termination: The ILUA is binding from the date when signed by all the parties. It has effect as an ILUA and in relation to the agreed acts from its registration on 16 July 2019. Native Title Provisions Right to negotiate: The parties agree that the right to negotiate provisions of the Native Title Act 1993 (Cth) do not apply to any of the future acts agreed to. Future act provisions: To the extent that the grant of the lease can be considered an invalid future act, the parties agree to validation of the lease where the lease has been granted after the execution date and before the registration date. Native Title in the Agreement Area: The ILUA area is within the area of the native title determination Dauan People v State of Queensland [2000] FCA 1064.
