The Extract from the Register of Indigenous Land Use Agreements describes the area covered by this agreement as Lot 5107 on PH620, Lot 59 on SK3, Part Lot 4 on SP120452, Lot 1 on LA2 and Lot 2 no WON4, with a combined area of about 4,326 sq km and located approximately 50km south of Normanton. Summary Information:

The Gkuthaarn, Kukatj and Stanbroke Indigenous Land Use Agreement (ILUA) was agreed, under the provisions of the Native Title Act 1993 (Cth), between:

  • Phillip George and Leanne Edwards on their own behalf and on behalf of the Gkuthaarn and Kukatj People;
  • Gkuthaarn and Kukatj Aboriginal Corporation; and
  • Stanbroke Pty Limited, Mowburn Nominees Pty Limited, Debra Louise Menegazzo, David Angelo Menegazzo and Brendan Peter Menegazzo and the State of Queensland (acting through the Department of Natural Resources, Mines and Energy).

The purpose of the ILUA is to provide for the extinguishment of native title in specified Lots of land within the area of the Gkuthaarn and Kukatj native title determination application.

The Native Title Representative Body for this area is the Carpentaria Land Council Aboriginal Corporation, Queensland South Native Title Services Ltd.

Details of the Agreement:

Background:

The ILUA was agreed during the negotiations for the native title determination made in favour of the Gkuthaarn and Kukatj People by consent of the parties on 29 September 2020. For details of the determination see 'native title in the area' below.

Commencement and Termination:

The ILUA is binding from the date when signed by all the parties. It has effect as an ILUA, and in relation to the agreed acts, from its registration date. 

Native Title Provisions:

Extinguishment:

The parties consent to the surrender of any native title that may exist in relation to the agreement area.

Future Act Provisions:

The Gkuthaarn and Kukatji People consent to the surrender of any native title rights and interests that may exist in:

  • Lot 5107 on PH 620;
  • Lot 59 on SK3; and
  • the parts of Lot 4 on SP120452, Lot 1 on LA2, and Lot 2 on WON 4, which are within the Gkuthaarn and Kukatj native title determination application. See Scheule 1 and 2 attached below under documents. This application has since been determined (see 'native title in the area' below).

Native Title in the Agreement Area:

The ILUA area is within the area of the native title determination George on behalf of the Gkuthaarn and Kukatj People v State of Queensland [2020] FCA 1310. (FCA file no.: QUD29/2019, NNTT file no: QCD2020/002).
