Summary Information:
The Gudjala People and State of Queensland and Dianne Rose Patterson Indigenous Land Use Agreement (ILUA) was agreed, under the provisions of the Native Title Act 1993 (Cth), between: Dianne Rose Patterson; Ngrragoonda Aboriginal Corporation RNTBC; and State of Queensland (acting through the Department of Natural Resources and Mines). The purpose of the ILUA is to provide consent for the extinguishing of native title in the ILUA area, and for title over the ILUA area and the Patterson property to be issued to Dianne Rose Patterson. The Native Title Representative Body for this area is North Queensland Land Council Native Title Representative Body Aboriginal Corporation.
Detailed Information:
Details of the Agreement: Commencement and Termination: The ILUA is binding from the date when signed by all parties. It has effect as an ILUA, and in relation to the agreed facts, from its registration date. The ILUA can be terminated only with written agreement by all parties. Native Title Provisions: Right to negotiate: The parties agree that the right to negotiate provisions of the Native Title Act 1993 (Cth) do not apply. Extinguishment: The parties consent to the surrender and extinguishment of native title rights and interests over the ILUA area. Future act provisions: The parties agree to the surrender and extinguishment of native title, and to the State granting title over the ILUA area and the Patterson property to Dianne Rose Patterson. Native Title in the Agreement Area: The ILUA area is within the area of native title determination Elizabeth Dodd & Ors on the behalf of Gudjala people Core Country Claim v State of Queensland & Ors [2014] FCA 231 (Gudjala People #2) (NNTT file no: QCD2014/007; Federal Court file no.: QUD147/2006).
