Gurambilbarra Wulguruka People and J & MM Lowth Pty Ltd Indigenous Land Use Agreement (ILUA)

Registered with the National Native Title Tribunal on the Register of Indigenous Land Use Agreements on 23 October 2020. This is an authorised area agreement agreement under the Native Title Act 1993 (Cth).

The Gurambilbarra Wulgurukaba People and J & MM Lowth Pty Ltd Indigenous Land Use Agreement (ILUA) was agreed, under the provisions of the Native Title Act 1993 (Cth), between:

• J & MM Lowth Pty Ltd;
• the State of Queensland acting through the Department of Natural Resources, Mines and Energy; and
  
• Virginia Wyled, Christine George, Brenton Creed, Florence Watso, Lynette Forbes-Beitsch, Pam Petrina Hegarty, Gail Ambrym, Esalyn Ambrym on their own behalf and behalf of the Gurambilbarra Wulgurukaba People.
  

The purpose of the ILUA is to provide for the extinguishment of native title over the ILUA area and grant a freehold title to J & MM Lowth.

The Native Title Representative Body for this area is North Queensland Land Council Native Title Representative Body Corporation.

Details of the Agreement:

Commencement and Termination:

The ILUA commences and is binding on the parties from the date it is signed by all the parties. It commences as an ILUA, and in relation to the agreed future acts, upon registration.

Native Title Provisions:

Extinguishment:

The parties agree that the surrender of native title rights and interests over the ILUA area is intended to extinguish those rights and interests.

Future act provisions:

The parties consent to:

• the surrender of native title over the ILUA area (Lot 28 on WG293). See the map in Schedule 1 of the ILUA attached below under documents; and
  
• the State granting a freehold estate over the ILUA area to J & MM Lowth.
  

Native Title in the Agreement Area:

The ILUA area is within the area of the Gurambilbarra Wulgurukaba Peoples' application for a determination of native title (FCA file no.: QUD623/206; NNTT file no.: QCD2016/007).
