The area for determination include the lands and waters in the southern region of the Gulf of Carpentaria in North Queensland. The area comprises an area of approximately 2,273.81 square kilometres, and is specifically described in as; (a) Lot 4536 on SP204559 and (b) Lots 1 and 2 on SP204559 as referred to in Schedule 4 and 6 of the determination. As per the determination map in Schedule 6, Lot 4536 is depicted in dark blue whilst Lots 1 and 2 are depicted in light blue. Background A native title application was filed by Mr Terence Details of Judgment The Court was satisfied that the agreement was freely reached by the parties and that therefore it was not necessary to hold a new hearing. The Court found that the Gangalidda People hold native title (pursuant to s 225 of the Native Title Act 1993 (Cth)) in the determination area by referring to evidence in a prior successful native title case in the same area brought by the Gangalidda People: Lardil v State of Queensland [2004] FCA 298. | ||
