The Extract from the Register of Indigenous Land Use Agreements describes the area covered by this ILUA as about 271 sq km located about 7.5 km east of Forsayth and north of the Robertson River.

Schedule 1 of the ILUA further identifies the area covered as all the land and waters within Lot 5 on GB835476 and that part of Lot 4926 on SP258874, excluding the southern severance of Lot 4926 being that area south of an east-west unnamed road west of Robertson River. Schedule 1 also records the exclusion from the ILUA area of Lot 29 on Plan GB14, Lot 4 on Plan GB835475, and Lot 23 on Plan SP129842. For more information see the documents attached.

The area is within the jurisdiction of the Etheridge Shire Council.

Legal Status:

Registered on the Register of Indigenous Land Use Agreements on 15 March 2023. This is an authorised body corpororate agreement under the Native Title Act 1993 (Cth).

Summary Information:

The Forsayth Wind Farm Amendment Indigenous Land Use Agreement (ILUA) was agreed, under the provisions of the Native Title Act 1993 (Cth) (the NTA), between Forsayth Wind Farm Pty Ltd and the Ewamian People Aboriginal Corporation RNTBC.

This ILUA provides the parties' consent to amend the Ewamian People - Forsayth Wind Farm ILUA so that the written description and map of the ILUA area more clearly identify the areas excluded. An inaccurate lot description is also corrected (Lot 4962 (sic) is amended to read Lot 4926).

The Native Title Representative Body for this area is the North Queensland Land Council Native title Representative Body Aboriginal Corporation.

Background to the Agreement 

This ILUA amends the Ewamian People - Forsayth Wind Farm Indigenous Land Use Agreement (ILUA) to more correctly and accurately describe the ILUA area.

Commencement and Termination

This ILUA commenced on 9 December 2021 and has no specified end date.

Native Title Provisions

The ILUA does not involve the doing of any future acts and does not affect the future acts negotiated in the making of the Ewamian People - Forsayth Wind Farm ILUA.

Native Title in the Agreement Area

The ILUA area is within the Ewamian People's native title area as determined in Fisher on behalf of the Ewamian People #3 v State of Queensland [2013] FCA 1249 (Ewamian People #3).
