Summary Information:

The St Ives Pistol Club and Awabakal and Guringai People and Ors Indigenous Land Use Agreement (ILUA) was agreed, under the provisions of the Native Title Act 1993 (Cth), between:

  • those named signatories to this agreement on their own behalf and on behalf of the Awabakal and Guringai People together with all other Aboriginal people who hold or who claim to hold native title rights and interests over the ILUA area, and
  • the St Ives Pistol Club Incorporated.

The purpose of the ILUA is to provide consent for the granting of a Crown Lease over Crown land adjacent to the St Ives Pistol Club.

The Native Title Representative Body for this area is NTSCORP Limited.

Details of the Agreement:

Agreement area:

The ILUA consists of three parcels of Crown Land:

  1. Crown land Lot 1 on DP1258827 with an area of 1.242 hectares (see the red highlighted area on the map in Schedule 1)
  2. part of Crown Land Lot 7312 on DP1166379 with an area of 0.509 hectares (see the blue highlighted area on the map on schedule one)
  3. part of Crown Land Lot 7312 on DP1166379, in which a 10 m wide easement will be created leading from Mona Vale Road to the leased area on Lot 437 on DP1166379 and Lot 101 on DP 1106750 (see the green highlighted area on the map on Schedule 1).

Commencement:

The ILUA is binding from the date it was signed by all the parties, 15 February 2020. It has effect as an ILUA, and in relation to the future acts, from the registration date, 1 September 2010.

Termination:

The termination details of this ILUA are not specified in the Extract attached below.

Native Title Provisions:

Right to negotiate:

The right to negotiate provisions of the NTA apply, as the ILUA has not stated otherwise.

Extinguishment:

The parties agree that the non-extinguishment principle applies. This means that any of the activities authorised under this ILUA which may be inconsistent with native title rights and interests do not extinguish these rights and interests, instead they are revived when the activities are finished.

Future act provisions:

The parties agree to:

  • the granting of a Crown lease over the three parcels of Crown Land that comprise the ILUA area.

Native Title in the Agreement Area:

The ILUA area is within the native title claim area Kerrie Brauer & Ors on behalf of the Awabakal and Guringai People (NNTT file no.: NC2013/002; FCA file no.: NSD780/2013). Thia application was dicontinued on 28 June 2017.
