Summary Information:
The Birriah People and Res Indigenous Land Use Agreement (ILUA) is an Area Agreement between:

- Denny Res and Jean Res;

- David Miller, Colin McLennan, Gracelyn Smallwood, Algon Walsh Junior and Frank Fisher as the Applicants for Native Title Determination Application QUD6224/1998 (Birriah People); and

- the State of Queensland.

The purpose of this Agreement is to extinguish Native Title in the Agreement Area.

Commencement

This ILUA was registered with the Register of Indigenous Land Use Agreements on 19 May 2015.

The Extract does not provide a specific start or end date for the Agreement.

The Extract does note, however, that the Agreement commences on the Execution Date, being 6 January 2015. Clause 4 of the Agreement commences on the Date of Registration, being 19 May 2015.

Native Title Provisions

The Parties to the Agreement consent to the Surrender. Surrender will extinguish any Native Title in relation to the Agreement Area.

Part 2 Division 3 Subdivision P of the Native Title Act 1993 (Cth), the Right to Negotiate, is not intended to apply to the Surrender.


Native Title in the ILUA Area

The Agreement Area includes all of the land and waters within that part of Lot 2 on SP257306 formerly part of Lot 26 on GS1023 located within the Native Title Determination application QUD6244/98 of Birriah People (QC98/12).
