Mapoon Township Community Development Indigenous Land Use Agreement (ILUA) was agreed between the State of Queensland, Mokwiri Aboriginal Corporation RNTBC, Mapoon Aboriginal Shire Council, and Alwyn Peter, Cameron Hudson, Maggie Peter, Sandy Parry, Stephen Parry, Lizzie Clermont, Christina Clermont, Relcy Clermont, Josphine Samson-Narara, Vanessa Reardon, Troy Readon, Lottie Luff, Florence Luff and Harriet Flinders on their own behalf and on behalf of the Traditional Owners.

The ILUA covers about 12.3 sq km in the vicinity of the township of Mapoon and the Old Mapoon Road.

The purpose of the ILUA is to provide consent for a range of acts regarding setting up a body corporate for the purpose of community development and development

The Native title Representative Body for this area is the Cape York Land Council Aboriginal Corporation.

Details of the Agreement:

The agreement area covers about 12.3 sq km in the vicinity of the township of Mapoon and the Old Mapoon Road. Schedule 1 of the agreement (attached below) depicts the area covered, as well as identifies the lot numbers covered.

Commencement:

The ILUA commenced on 29 February 2016 (the date it was signed by all the parties).

It has effect as an ILUA from the date it was entered on the National Native Title Tribunal Register of Indigenous Land Use Agreements (28 June 2016).

Native Title Provisions:

The ILUA does have statements that reference ss 24EB(1) or 24EBA(1) or (4) of the Native Title Act 1993(Cth).

The parties agree to the following acts, subject to the terms of the agreement:

  • the grant of a homeownership lease;
  • the grant of a social housing lease, the construction, operation and maintenance of social housing, and the granting of residential tenancy agreements;
  • the doing of council infrastructure acts;
  • the doing of development within the Red Beach Precinct or the Airport Land and Industry Precinct (including the grant of development tenures);
  • the grant of a State lease and the development of the Office Project;
  • the surrender of the whole or part of the Deed of Grant in Trust ('DOGIT') under the Land Act and its reissue to change its boundaries.
