Barada Barna People/Killarney Indigenous Land Use Agreement (ILUA) was agreed between the Barada Barna People and Trevor Harold Bradford.

The agreement area covers about 160.5 sq km, located approximately 74 km northeast of Middlemount.

The purpose of the ILUA is to provide consent for a range of acts regarding access to land that is subject to pastoral leases.

Details of the Agreement:

The agreement area covers about 160.5 sq km, located approximately 74 km northeast of Middlemount.

The agreement area covers all the land and waters subject to the pastoral lease over Lot 799 on Plan PH391 (Killarney), the term lease over Lot 4 on Plan KL65 (Reserve) and the pastoral lease over Lot 3161 on Plan PH378 (Kelman).

Commencement:

The ILUA commenced on 29 June 2016 (the date the determination of native title was made).

Native Title Provisions

The ILUA does not have statements that reference subsection 24EB(1) or 24EBA(1) or (4) of the Native Title Act 1993(Cth). This means that any activities by the non-native title party under this agreement do not affect the Barada Barda Peoples' native title rights and interests.

Native Title in the ILUA Area:

The agreement area is within the determination area of the Federal Court proceeding Les Budy and Cecil Brown Jnr & Ors on behalf of the Barada Barna People v State of Queensland (Barada Barna People) [2016] FCA 1271 (FCA file no.: QUD380/2008; NNTT file no.: QCD2016/007).
