Summary Information:
'In Wi Parata v Bishop of Wellington the Supreme Court considered the effect of a Crown grant of land issued to the Bishop of Wellington. There had been no extinguishment of Maori title prior to the grant. Prendergast CJ held that the issue of a crown grant implies that the Crown intended to extinguish native title. Further, executive decision to extinguish was not justiciable. According to Prendergast CJ, Maori have mere rights of occupation.' (Dorsett and Godden, 94).
