Summary Information:
The Aboriginal Land Grant (Jervis Bay Territory) Act 1986 (Cth) (the Act) is, according to the long title, 'an Act to grant land in the Jervis Bay Territory to the Wreck Bay Aboriginal Community, and for other purposes'. The Act provides for grants of land in the Jervis Bay Territory of the Australian Capital Territory (ACT), and is the only legislation in the ACT to implement Aboriginal land rights.
Detailed Information:
The Act establishes the Wreck Bay Aboriginal Community Council (the Council), a body corporate which will: hold title to Aboriginal land; exercise its powers as owner of land for the benefit of members of the Community; provide community services to members of the Community, conduct business enterprises for its economic or social benefit, and take action in relation to its housing, social welfare, education, training or health needs; and protect and conserve natural and cultural sites on Aboriginal land, and manage and maintain Aboriginal land (s 6). The Act also sets out procedures for the administration and membership of the Council. In 2003 the Aboriginal Land Grant (Jervis Bay Territory) Amendment Act 2003 (Cth), containing amendments designed to facilitate the operations of the Council, was passed.

The Act provides for an initial grant to the Council of 403 hectares of land surrounding the Jervis Bay Village (described in the Schedule to the Act) (s 8). The Act also provides for further grants of vacant Crown land adjoining the Schedule land (s 9), and land within the Jervis Bay (now Booderee) National Park (s 9A), where the Minister is satisfied that such land is of significance to Aboriginals who are members of the Community, and that it would be appropriate to grant the land to the Council.
