Although this category usually refers to binding contracts made between parties, it may also include any agreements made in the course of commerce, such as non-binding pre-contractual arrangements between parties. By convention this category does not include agreements made under statutory regimes dealing with native title rights, as those rights cannot be sold in the open market. |
